ODAR Hearing Processing Times
Below is the Rank, Hearing Office (ODAR), and Processing Time (time it takes in days on average from time you request
hearing until you get a decision) as of the month ending 2/25/2011. As you can clearly see the time it takes to get
a decision at hearing stage for each hearing office has changed in most cases quite a bit from the last time I posted the
National Ranking Report. The reason you see sometimes drastic changes in a hearing offices rank for some ODAR's could
be any number of reasons. One reason is, because the Social Security Administration specifically targets those hearing
offices with the longest wait times by using Administrative Law Judges (ALJs) from other ODARs that are ranking well or from
their new National Hearing Centers (NHCs) to help handle the case load of the worst ranking hearing offices. Another
reason is that there was a recent hiring of many ALJs, and many may have been assigned to the ODARs with the highest
case loads. Yet another reason, maybe some states had a significant increase in the number of claimants requesting a
hearing possibly due to an economic downturn in that particular state. I believe Social Security's goal is to reduce
the overall backlog of cases at hearing by taking steps to reduce the waiting times at the worst ranked hearing offices which
in turn will hopefully bring down the national average wait time at the hearing stage which is now averaging
365 days. The only problem, which does not seem to have a clear solution, is that when you focus on some hearing
offices that rank poorly you sometimes increase the back log in hearing offices that ranked well. So even if your particular
ODAR is ranked very poorly, or if the opposite is true and your hearing office ranks highly, I think the national average
is a better way to determine how long it may take for an average case to be decided at the hearing level. If your hearing
office ranks particularly high, I think you can expect to see it drop in most cases in the next National Ranking Report for
Social Security Disability Hearings or soon after. I also believe, if your ODAR is ranked extremely poorly you
will probably see your hearing office go up in the rankings in the next National Ranking Report or soon after. It does
seem like some ODAR offices have stayed relativly consistent despite the changes, so if your hearing office consistently ranks
well or poorly, then this may be a better indicator for your wait time then the national average. The Social
Security Administration has taken may positive steps to reduce the backlog of cases that causes the long wait at hearing,
but the poor economy and baby boomer generation now turning retirement age have put significant stress on the system.
It also looks like Congress will begin to start cutting SSA's budget which will probably hurt their efforts to decrease the
time it takes to get a Social Security Disability or SSI decision at all stages of the process. I hope I am wrong.
